1. Who May Rent and Drive

• The primary Renter must be at least 21 years of age and hold a valid, unexpired government-issued driver's license.
• Every person who operates the cart must be 21 or older and licensed, and must be identified to us as an authorized driver. International driver's licenses are accepted.
• You are responsible for every person who drives or rides in the cart during your rental period, whether or not you authorized them.
• Passengers of any age are welcome. Children may ride but may never drive. Children under three must be secured in an appropriate child safety seat, which you must provide.
• Horsepower may decline or end a rental at any time, at our discretion, including where we believe a cart is being operated unsafely or by an unauthorized person.

2. Reservations, Rates & Billing

• Reserving is free. There is no deposit, no prepayment, and no money due at the time you reserve.
• You pay for what you use. Charges accrue based on the time the cart is in your possession and use, billed at the rates below.
• Rates for each 4-passenger cart:

• Hourly, seasonal, and multi-cart barn rates are available on request and, where agreed in writing, replace the rates above for that rental.
• Delivery and pickup within our Wellington service area are complimentary on every order.
• Rates are subject to change. The rates confirmed for your reservation govern that rental.
• We accept major credit and debit cards. Invoices are payable on receipt unless we have agreed otherwise in writing.
• There is no charge for mileage and no fuel surcharge. Our carts are electric; you supply ordinary household electricity while the cart is with you.

3. Changes & Cancellation

• Cancel any time before delivery at no cost. Because nothing is prepaid, there is nothing to refund and no cancellation fee.
• Extend, add carts, or return early by calling, texting, or using the app. Extensions and additional carts are subject to fleet availability. If you return early, you are billed only for the time you used.
• If we have already loaded and delivered carts to your address and you decline them on arrival, we may charge one day at the applicable daily rate per cart delivered.
• Changing your delivery address after carts are dispatched may delay delivery and, where the new address is outside our service area, may not be possible.

4. Delivery & Pickup

• Horsepower is a delivery-only service. There is no rental counter, lot, or pickup location. We bring the carts to your farm, barn, or home and we return to collect them.
• We deliver locally within Wellington, Florida and the surrounding show circuit. We do not deliver to cruise terminals, ferry docks, or airports, and we do not rent carts for use outside our service area.
• You must provide a safe, lawful, and accessible place to stage the carts, and you authorize us to enter the delivery address to deliver and retrieve them.
• We will confirm a delivery window in advance. You do not need to be present, provided you have told us where to leave the carts.
• At the end of your rental, leave the carts at the delivery address, charged and accessible, and end the rental in the app or notify us. Carts must remain at or near the delivery address for retrieval.
• If a cart is not available for retrieval at the agreed time and place, the rental continues to accrue at the applicable daily rate until we recover it.
• Carts must stay in the Wellington area. Carts may not be trailered, transported, or driven outside our service area without our written permission.

5. Charging & Cart Care

Our entire fleet is electric. Every cart is delivered clean and fully charged, with its charger.

• Charge the cart each night of a multi-day rental by plugging it into a standard household outlet. It will be ready by morning.
• Do not leave a cart sitting at a low state of charge, and do not allow the battery to fully deplete. Deep discharge can permanently damage the battery pack, and the resulting damage is chargeable to you under Section 7.
• Use only the charger supplied with the cart. Do not substitute, modify, or repair chargers or charging cables.
• Keep the charger and charging connection dry, and do not run the cable across walkways or through standing water.
• Return the cart in the condition it arrived, allowing for normal wear. Excessive interior soiling, manure, hay, mud, or pet hair requiring more than routine cleaning may incur a cleaning charge.
• Do not attempt any repair or maintenance yourself, including tires, batteries, and electrical components. Call us instead.

6. Rules of Operation

You agree that you and every driver and passenger will:

• Obey all applicable traffic laws, signs, and signals, and operate the cart only where golf carts are lawfully permitted in Wellington and Palm Beach County.
• Never operate the cart under the influence of alcohol, cannabis, prescription or illegal drugs, or anything else that impairs the ability to drive. Florida DUI law applies to golf carts.
• Not carry open containers of alcohol in the cart.
• Keep all occupants seated while the cart is in motion. No standing, no riding on the rear step or bumper, and no hanging outside the frame.
• Not exceed the cart's seating capacity of four passengers.
• Not smoke or vape in or around the cart.
• Not use the cart off-road, on the beach, in flooded areas, on jump courses or manicured footing, or on highways and roads where carts are prohibited.
• Not tow anything with the cart, and not overload it with tack, feed, or gear beyond its rated capacity.
• Not use the cart for any commercial passenger service, ride-share, delivery service, race, or contest.
• Not sublet, re-rent, sell, or lend the cart to anyone outside your authorized drivers.
• Not modify, alter, repaint, add equipment to, or tamper with the cart or any of its electronic systems.
• Lock the cart in the app whenever it is left unattended.

Violating this section may result in immediate termination of the rental without refund, retrieval of the cart, and responsibility for any resulting loss.

7. Damage, Loss & Fines

You are financially responsible for the following during your rental period:

• Damage to the cart from accident, negligence, misuse, or violation of this Agreement, beyond normal wear.
• Damage to the battery pack, charger, or electrical system caused by improper charging, deep discharge, or water exposure.
• Theft or loss of the cart, its charger, or any component, including where the cart was left unlocked or unsecured.
• Traffic citations, parking violations, tolls, and fines incurred while the cart is in your possession.
• Towing, impound, and recovery fees, including recovery of a cart taken outside our service area.
• Damage or injury you cause to any third party or their property.

We document the condition of each cart at delivery and again at pickup. We will provide an itemized invoice for any assessed repair, cleaning, or replacement cost, payable within 30 days of the invoice date. Where a cart is out of service for repair caused by you, we may also charge the applicable daily rate for the repair period.

8. Assumption of Risk & Liability

Operating a golf cart carries inherent risk. Carts are open vehicles without airbags, seat belts, or enclosed cabins. They can tip, and occupants can fall out. You acknowledge and voluntarily assume these risks on behalf of yourself, your drivers, and your passengers.

• You are responsible for the safe operation of the cart at all times.
• To the fullest extent permitted by Florida law, Horsepower is not liable for personal injury, death, or property damage arising out of your use of the cart, the acts of your drivers or passengers, or your violation of this Agreement.
• Horsepower is not responsible for personal property left in, on, or around the cart.
• You agree to indemnify and hold Horsepower harmless from claims, damages, and costs arising out of your use of the cart, except to the extent caused by our own negligence.
• Nothing in this Agreement limits any liability that cannot be limited under Florida law.

You are strongly encouraged to confirm that your own insurance covers your use of a rented golf cart.

9. Insurance

Horsepower carries commercial coverage on its fleet. That coverage does not extend to your personal liability or to injuries to you, your drivers, or your passengers. It is not a substitute for your own insurance, and it does not relieve you of responsibility for damage under Section 7.

10. App, Virtual Key & Cart Systems

• Carts are unlocked and locked through the Horsepower Wellington app using a virtual key on your phone. You are responsible for keeping a charged phone with Bluetooth enabled for the duration of your rental.
• Your virtual key is personal to your account. Do not share your account credentials.
• We are not liable for an inability to unlock a cart caused by your device failing, losing power, or losing connectivity. Call us and we will assist.
• Our carts contain telematics that report cart status, diagnostics, and location for fleet management, theft recovery, and support. We do not publish cart locations publicly and we do not sell this data. See our Privacy Policy.
• Tampering with, disabling, or attempting to circumvent any lock, telematics unit, controller, or other electronic system on the cart is strictly prohibited, terminates the rental immediately without refund, and may carry civil and criminal consequences.

11. Breakdowns & Our Service Commitment

• If a cart has a mechanical, electrical, or app issue that is not your fault, call us at 508-951-4755. We will repair it or bring you a replacement cart as quickly as we can.
• Your rental time pauses while a cart is out of service through no fault of yours, and you are not billed for that time.
• If we cannot resolve a significant issue, we will provide a replacement cart, a credit, or a refund of the affected time, at our discretion.
• Do not attempt roadside repairs. Stop driving a cart that is damaged or not operating correctly and call us.

12. Termination, Governing Law & Disputes

• Horsepower may terminate a rental and retrieve its carts immediately if this Agreement is violated, if a cart is being operated unsafely or unlawfully, or if payment is not made when due.
• We are not liable for failure to perform due to circumstances beyond our reasonable control, including severe weather, hurricanes, flooding, natural disaster, government action, utility failure, or supply disruption. Where that happens we will reschedule or credit where we reasonably can.
• This Agreement is governed by the laws of the State of Florida. Any dispute arising from a rental shall be brought in Palm Beach County, Florida. Both parties agree to attempt good-faith resolution directly, and then mediation, before starting formal proceedings.
• If any provision of this Agreement is found unenforceable, the remainder stays in effect.
• We may update this Agreement. The version in effect when you confirm your reservation governs that rental, and the current version is always posted at horsepowerwellington.com/rental-agreement.html.

• No hidden fees. There is no mileage charge, no fuel surcharge, and no mandatory insurance add-on. Our carts are electric; you supply ordinary household electricity while a cart is with you.

3. Cancellation & Changes

• Free cancellation before delivery. Because nothing is prepaid, you may cancel at any time before your carts are delivered at no cost. There is nothing to refund and no cancellation fee.
• Changes are free and subject to availability. Extend, shorten, add carts, or change your delivery date by calling, texting, or using the app.
• Early return. If you finish early, notify us and you will be billed only for the time you used.
• Declined delivery. If we have already delivered carts to your address and you decline them on arrival, we may charge one day at the applicable daily rate per cart delivered.
• Our service guarantee. If a cart has a mechanical, electrical, or app issue that significantly disrupts your rental through no fault of yours, we will pause your billing and provide a replacement cart, a credit, or a refund of the affected time.

4. Cart Use & Prohibited Activities

The renter agrees to:

• Operate the cart only where golf cart use is lawfully permitted under Florida, Palm Beach County, and Village of Wellington regulations.
• Obey all traffic laws, signals, and signs applicable to golf cart operation.
• Not operate the cart under the influence of alcohol, drugs, or any substance that impairs driving ability, and not carry open containers in the cart.
• Not permit anyone under 21, or anyone unlicensed, to operate the cart.
• Not exceed the cart's capacity of four passengers, and keep all occupants seated while the cart is in motion.
• Not smoke or vape in or around the cart.
• Not use the cart off-road, on beaches, on jump courses or manicured footing, in flooded areas, or on highways and roads where carts are prohibited.
• Not tow with the cart, overload it, or use it for any commercial passenger service, ride-share, delivery service, race, or contest.
• Not sublet, re-rent, sell, or lend the cart to anyone outside the authorized drivers on the rental.
• Not modify, alter, or tamper with any cart component, including batteries, chargers, controllers, and electronic systems.
• Keep the cart within our Wellington service area for the entire rental period unless we have given written permission otherwise.
• Charge the cart as directed and return it clean and free of excessive damage, normal wear excepted.

5. Responsibility for Damage & Loss

The renter is financially responsible for:

• Any damage to the cart caused by negligence, misuse, or accident during the rental period, beyond normal wear.
• Damage to the battery pack, charger, or electrical system caused by improper charging, deep discharge, or exposure to water.
• Theft or loss of the cart, charger, or any component, including where the cart was left unlocked or otherwise unsecured.
• Traffic citations, parking violations, tolls, and fines incurred during the rental period.
• Towing, impound, and recovery fees, including the cost of recovering a cart taken outside our service area.
• Cleaning charges where a cart is returned requiring more than routine cleaning.

Horsepower documents cart condition at delivery and at pickup. The renter agrees to pay assessed repair, cleaning, or replacement costs within 30 days of invoice. Where a cart is out of service for repairs caused by the renter, we may also charge the applicable daily rate for the repair period.

6. Insurance & Liability

Horsepower's fleet carries commercial vehicle insurance. This coverage does not extend to the renter's personal liability or to injuries sustained by the renter, their drivers, or their passengers.

• Golf carts are open vehicles. Renters assume all personal risk associated with golf cart operation on behalf of themselves, their drivers, and their passengers.
• To the fullest extent permitted by Florida law, Horsepower is not liable for personal injury, death, or property damage to any person arising from renter negligence, the acts of the renter's drivers or passengers, or violation of these Terms.
• Horsepower is not responsible for personal property left in, on, or around a cart.
• Renters are strongly encouraged to carry their own personal insurance coverage and to confirm that it covers use of a rented golf cart.
• Nothing in these Terms limits any liability that cannot be limited under Florida law.

7. Mobile App & Cart Systems

• Cart unlock and lock are managed through the Horsepower Wellington mobile app using a virtual key on your phone.
• The renter is responsible for keeping a charged, Bluetooth-enabled smartphone for the duration of the rental.
• Horsepower is not liable for an inability to operate the cart due to the renter's device failing, losing power, or losing connectivity. Call us and we will assist.
• Carts contain telematics used for fleet management, diagnostics, theft recovery, and support. We do not publish cart locations publicly and we do not sell this data. See our Privacy Policy.
• Tampering with, disabling, or attempting to circumvent any electronic control system on a cart is strictly prohibited, results in immediate termination of the rental without refund, and may carry civil and criminal consequences.

8. Delivery & Return

• Horsepower is a delivery-only service. There is no rental counter or pickup location. We deliver to and retrieve from your address within our Wellington service area.
• We do not deliver to cruise terminals, ferry docks, or airports, and we do not rent carts for use outside the Wellington area.
• The renter must provide safe, lawful, and accessible space to stage the carts, and authorizes Horsepower to enter the delivery address to deliver and retrieve them.
• At the end of the rental, carts must be left at the delivery address, charged and accessible, and the rental ended in the app or by notifying us.
• If a cart is not available for retrieval at the agreed time and place, the rental continues to accrue at the applicable daily rate until we recover it. If you cannot make a cart available, contact us immediately at 508-951-4755.

9. Force Majeure

Horsepower is not liable for failure to perform obligations due to circumstances beyond our reasonable control, including hurricanes, severe weather, flooding, natural disasters, government action, utility outages, or infrastructure and supply failures. In such events we will offer rescheduling or credit where reasonably possible.

10. Governing Law & Disputes

These Terms are governed by the laws of the State of Florida. Any dispute arising from a rental shall be resolved in Palm Beach County, Florida. Both parties agree to attempt good-faith direct resolution, and then mediation, before initiating formal legal proceedings. If any provision of these Terms is found unenforceable, the remainder stays in effect.

11. Amendments

Horsepower reserves the right to update these Terms at any time. The version in effect at the time of your reservation governs your rental. Current Terms are always available at horsepowerwellington.com/terms.html.

1. Information We Collect

Information You Provide Directly

• Reservation information: Name, email address, phone number, delivery address, number of carts, and rental dates when you reserve through our website, by phone, or by text.
• Driver information: Driver's license details for the renter and any additional authorized drivers, as required by our Rider & Rental Agreement.
• Payment information: Card details used to pay for a rental, processed by our payment provider. We do not store full card numbers on our own systems.
• Contact inquiries: Anything you send through our contact form, by email, or by text message.
• Account information: If you create an account in our app, your username, encrypted password, and rental history.

Information Collected Automatically

• Usage data: Pages visited, time on site, browser type, IP address, and referring URLs.
• Device data: Device type, operating system, and unique device identifiers when you use our app.
• Cart telematics: Our carts report status, diagnostics, charge level, and location to us for fleet management, maintenance, support, and theft recovery. We do not display cart locations publicly, we do not operate a public live map, and we do not sell this data.
• App location (app only): With your permission, approximate device location to enable unlock and rental features. We do not sell location data.

Information from Third Parties

• Form delivery provider: Reservation and contact form submissions are transmitted to our inbox through a third-party form service. Their privacy policy governs that transmission.
• Payment processor: Payment and transaction data processed on our behalf when you pay for a rental.

2. How We Use Your Information

We use your information to:

• Process and confirm cart reservations
• Schedule and complete delivery and pickup at your address
• Communicate with you about your rental — confirmations, delivery windows, reminders, invoices, and receipts
• Respond to your questions and support requests
• Verify driver eligibility as required by our Rental Agreement
• Enable unlock and rental features in our app
• Maintain, service, and recover our fleet
• Bill for rentals and assess any damage under our Terms
• Improve our website, app, and service
• Send offers or seasonal updates — only if you opt in
• Comply with legal obligations and protect our rights

We do not sell your personal information to third parties.

3. How We Share Your Information

We share your information only in these limited circumstances:

• Service providers: Our form delivery service, payment processor, hosting provider, and web font provider. Each receives only what it needs to perform its function.
• Legal requirements: If required by law, subpoena, court order, or government authority, or to investigate theft of or damage to our property.
• Insurance and claims: Where necessary to process an insurance claim or a damage or liability matter arising from your rental.
• Business transfers: In the event of a merger, acquisition, or sale of assets, your information may transfer as part of that transaction.

4. Cookies and Tracking

Our website uses only what it needs to function. We do not run advertising trackers and we do not sell browsing data. Where cookies or similar technologies are used, they serve to:

• Keep you signed in across sessions in the app
• Remember your preferences
• Understand aggregate, anonymized traffic patterns

You can disable cookies in your browser settings, though some features may not work properly if you do. Our site loads typefaces from Google Fonts, which receives your IP address as part of serving those files.

5. Data Retention

We retain your personal information for as long as your account is active or as needed to provide services and comply with legal obligations. Rental and billing records are retained for a minimum of 3 years for accounting and tax purposes. Cart telematics records are retained only as long as needed for fleet management and support. You may request deletion of your personal data at any time — see Section 7.

6. Data Security

We use commercially reasonable technical and organizational measures to protect your information, including encrypted transmission (HTTPS), secure storage, and access limited to authorized personnel. No method of transmission over the Internet is completely secure, however, and we cannot guarantee absolute security.

7. Your Rights

Depending on your location, you may have the right to:

• Access: Request a copy of the personal data we hold about you.
• Correction: Request that we correct inaccurate or incomplete information.
• Deletion: Request that we delete your personal data, subject to legal and accounting retention requirements.
• Opt out: Unsubscribe from marketing messages at any time using the link in any email, or by replying STOP to a text.

8. Children's Privacy

Our services are not directed to children under 18, and only people aged 21 or older may rent or drive our carts. We do not knowingly collect personal information from minors. If you believe we have inadvertently collected information from a child under 18, contact us and we will delete it.

9. Text Messages

If you give us your phone number, we may text you about your reservation, delivery window, pickup, or an issue with your cart. Message and data rates may apply. Reply STOP to opt out of non-essential messages; we may still need to contact you about an active rental.

10. Third-Party Links

Our website may link to third-party sites and app stores. We are not responsible for the privacy practices of those sites and encourage you to review their policies.

11. Changes to This Policy

We may update this Privacy Policy periodically. When we do, we will revise the Effective Date at the top of this page. Continued use of our services after any change constitutes acceptance of the updated policy.
